Purchasing and using products and services
MyTravelPhone services and our website are available only to individuals who can form legally binding contracts . You must be at least eighteen (18) years old in order to purchase our products and services. If you do not qualify, please leave our website and do not attempt to make purchases.
MyTravelPhone may refuse or cancel any order placed by you We reserve the right to refuse or cancel any order without giving a specific reason; however if such an event occurs, we will notify you by email.
MyTravelPhone will make every practical effort to ensure that all our services are continuously available to you. However, please note that there may be times or circumstances that affect the availability of services. Both availability and quality can sometimes be impacted by issues that are beyond our control, such as weather, problems with other communications networks that are interconnected to our network, your proximity to physical structures that block reception and other factors that might result in radio interference. Quality may also be affected when you make calls from inside buildings or underground.
The MyTravelPhone service and network availability may, at times, be affected by scheduled or unscheduled maintenance, change or upgrading operations. When this occurs, we will do everything in our power to provide you with notice (in the case of scheduled work) and with alternative service. Although we will strive to minimize downtime, some service interruption may be unavoidable.
Please be advised that roaming is dependent upon the telecommunications systems of foreign networks. As we have not control over these networks, we cannot therefore offer any warranties, express or implied, concerning the quality of roaming services.
If MyTravelPhone has reason to believe that you are in breach of one or more of the terms of your contract or these Terms and Conditions, we may suspend some or all of the services that you use, without notice.
MyTravelPhone reserves the right to discontinue the participation privileges of any customer who engages in any fraudulent acts or in a manner that is not consistent with these Terms and Conditions, any federal or state laws, statutes, or ordinances. In addition, MyTravelPhone reserves the right to take any administrative and/or legal action that we feel appropriate, including criminal or civil prosecution.
Your MyTravelPhone SIM card main number and account will expire if you do not make any calls for two (2) years. Extra numbers will remain operational as long as you continue to fund them. Your MyTravelPhoen Sim card balance is valid for 1ten (10) months. You can roll over your balance to the next ten (10)-month period as long as you add at least $25 within ten (10) months after your last top-up. If your balance expires, you can still continue to use our service after you recharge your MyTravelPhone SIM card.
Refunds and money-back guarantee
If you are not satisfied with your MyTravelPhone SIM card purchase, you may return it for exchange or refund (excluding shipping and handling costs) within thirty (30) days from the date of purchase, as long as you have never placed from or received a call to the SIM card and no airtime has been used.
Please be advised that there are no refunds for airtime, and the money-back guarantee extends only to the MyTravelPhone SIM card itself.
Please keep your purchase, accessories and all packing materials in new and unused condition to avoid any restocking fees. For an RA (Return Authorization) number, please call MyTravelPhone Customer Support at 1-305-767-2722. Please note that an RA # is required for a an exchange/return but that it does not guarantee final disposition, and all returns are subject to inspection before any refunds may be issued. All exchanged/returned merchandise must be in their original packaging with all packaging materials, inserts and manuals, warranty cards (not completed) and all accessories. Please do not staple, tape, glue or write anything on the item or the original packaging. In some cases, we may withhold or reduce your credit or otherwise charge you for the replacement of missing, damaged, altered, written-,r taped- stapled-on packaging or packaging contents. MyTravelPhone reserves the right to refuse the return of any such items.
We regret that we cannot issue refunds for:
- Airtime used on mis-dialed calls. (If you are unsure how to dial a number in a specific country, please request assistance from MyTravelPhoen Customer Support.)
- Sent SMS/text messages, regardless of whether they were received by the recipient.
- Minutes used for calls to MyTravelPhone Customer Support. Calls to Customer Support will be billed at the same rate as any other call made from your location, as indicated in the Rates and Coverage menu of www.mytravelphone.net
Please be advised that calls made from the United States or Canada are very expensive, and you may therefore wish to avoid making such calls. You can check the rates for such or for any calls by making a not-completed call from your MyTravelPhone card and not answering when your receive a callback. There will be no charge for this call if you did not answer the callback ring. Contact MyTravelPhone Customer Support for questions or assistance.
Customer is free to use up the remaining airtime balance on the account while account is still active. The SIM card and account will not expire. However, the SIM balance will be active for ten (10) months after it has last been recharged. On the timely recharge the previous balance will roll over to the next ten (10) month period.
MyTravelPhone will exchange a defective SIM card within three (3) months of the purchase, provided that the SIM is returned undamaged.
As a MyTravelPhone customer, you understand and acknowledge that when you access our Website or submit or receive information on it, that this may involve transmission over various networks, in some cases other than our own, an that we may make changes to conform and adapt to the technical requirements of connecting networks or devices.
MyTravelPhone is not responsible for:
- Incorrect, inaccurate or incomplete transcription of information;
- Problems or issues related to any of the equipment or programming associated with the website or utilized by you;
- Any human error or printing error;
- Any interruption, deletion, omission, defect, or line failure of any telephone network or electronic transmission;
- Difficulties relating to computer equipment, software, or inability to access the MyTravelPhone Web site;
- Any other technical or non-technical error or malfunction.
By becoming a MyTravelPhone customer, you accept all responsibility for, and hereby indemnify and hold harmless Atlantic Communications, LLC, MyTravelPhone, each of its related companies, and each such company's respective officers, directors, employees, shareholders, agents, and successors, and assigns (the "Released Parties"), from and against any claims that may arise from actions taken by you. We accept no liability for any indirect or consequential loss or damage, or for any direct or indirect loss of data, profit, revenue or business in each case, however caused, even if foreseeable. In circumstances where you suffer loss or damage arising out of or in connection with the viewing, use or performance of the Website or its contents other than as a direct result of purchasing Products (which shall be subject to the exclusions and limitation of liability set out in these terms and conditions), we accept no liability for this loss or damage (except where we have been negligent) whether due to inaccuracy, error, omission or any other cause and whether on the part of Atlantic Communications or MyTravelPhone or our employees, agents or contractors or any other person or entity.
Except where prohibited, you agree that any and all disputes, claims, and causes of action arising out of or connected with your use of our products and services shall be resolved individually without resort to any form of class action and exclusively by arbitration under the Commercial Arbitration Rules of the American Arbitration Association and any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred for the products and services, but shall not include attorneys' fees under any circumstances. In addition, you hereby waive all rights to claim punitive, incidental, and consequential damages.
If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
You may cancel or terminate services at any time by providing written notice to MyTravelPhone Customer Support at support@mytravelphone.net
